Listicle of the Week. This is one of those weeks when there are so many diverse and interesting stories, we despair at the task of creating a coherent narrative for our readers. Instead, we must resort to trusty old listicle to present you with the items we think you'll find most worth reading:
- Matters Tick Up, Billings and Collections Tick Down The formal definition of a recession is two successive quarters of falling GDP. In the legal market, I prefer an alternative indicator: when even blue-chip clients like KKR start schnorring around looking for a discount on legal fees. According to this week's headlines, we've reached that point and then some. This Bloomberg story describes the weakness in billing rates and collections among the ranks of BigLaw, while the latest survey data from Clio shows much the same among the small law contingent.
- How Green is the Valley? Very interesting story from Roy Strom about Paul Weiss's search for new green pastures in Silicon Valley. The money quote: "only half of the eight Wall Street firms that have launched Silicon Valley offices since 1991 currently have more than 40 lawyers there." It was Winston Churchill (not Steve Jobs) who defined success as "walking from failure to failure with no loss of enthusiasm." Best of luck to Brad Karp and his team!
- Hoteling Gets a Second Look It was no less an expert than David Maister who first warned BigLaw firms about the dangers of hoteling, a management practice he found to be inimical to building long-term stability and trust. But now in the era of COVID-19, even hoteling is getting a second look; as this article by a deputy managing partner of Wilson Elser explains, it may very well represent the look of the law firm of tomorrow!
- The Virtues of Virtual Living Surely I'm not the only one to notice this irony: thanks to Zoom, the last three months in virtual seclusion have allowed me to spend more time with far-flung friends and family than would have possible in a decade-without-lockdown. So it is that law firm network TerraLex has decided to make a virtual meeting part its regular post-COVID-19 routine thanks to discovering that attendance at this year's virtual event reached an all-time high.
- Reverse Innovation A really interesting article from HBR this week about the value of reverse innovation - lessons that we in the developed world stand to learn from our brothers and sisters in less developed countries. All hail Vietnam, a country with 95 million inhabitants and zero COVID-19 fatalities!
- Best of the Best Truly, one of the highlights of the year in legal marketing comes with Clio's publication of the Best Law Firm Websites. This year's list doesn't disappoint, with a number of standouts. I'm not sure this qualifies as an example of reverse innovation, but BigLaw marketing teams certainly stand to learn something from these small firm websites, particularly when it comes to writing effective tag lines and punchy website copy.
- To Everything, Churn, Churn, Churn As if there's not already enough turmoil in the market, there's this bit of eye-popping data from BTI Consulting Group: 21% of the top decision-makers in corporate law departments are on the verge of leaving their posts, either due to retirement or jumping ship. The message is clear: it's time for law firm marketing teams to start buffing up their pitch books!
- Manage Less, Accomplish More If you work for a law firm, big or small, the odds are pretty good that there are one or more micro-managers ready to make life miserable. Well, this blog post does a great job explaining why so much management effort proves to be completely futile when it comes to getting the best results from the team. Now the only problem is to figure out how to get the micro-manager in your life to read the article.
- Ooo, Ooo, What a Little Business Savvy Will Do Sorry, but I find it increasingly difficult to hide my disdain for what passes for market research these days. Take for example, this latest report from Acritas, which reveals the special sauce that will turn any humdrum practitioner into a Stellar Performer! Drum roll please. It's Business Savvy! And this latest groundbreaking research from Acritas further reveals that understanding clients and their needs is important too!
- Vampire Squid Update And last but not least, everyone's favorite vampire squid announced the hiring of a new head of marketing, Fiona Carter, formerly the Brand Chief at AT&T. Well out of the frying pan and into the fire and good luck Fiona! At least now you won't have to struggle with the confusing welter of brands such as HBO, Digital TV, etc. etc. In recent years, Goldman has streamlined its messaging with its powerful "One Goldman approach." With Fiona's arrival, the firm is rumored to be working on a campaign refresh. My suggestion to the creative team would be: "One Squid, Many Tentacles." Consistency in branding and messaging is important after all!
