You don't want to see...
As I read the title of this post, I started thinking back to my days at Rust Consulting and the litigation support work (eDiscovery now) I did and the kinds of things I hated to see in a case. I came up with four of the ten, which considering I haven't actively worked in eDiscovery in over twenty years, is actually pretty sad. My list included: CAD/CAM, Macintosh emails, email archives and legacy email formats. Although when I was thinking of legacy email formats, it wasn't MBox, GroupWise, and Lotus Notes, but rather DEC PDP-10, CCI and a few other minicomputer systems. For the rest of the list, read more at JD Supra: 10 Things You Don't Want to See in eDiscovery

Life after death by PowerPoint?
Here is a post I plan to share far and wide in my firm. You don't have to be a litigator or going to trial to take advantage of Craig Ball's presentation tips. While I religious followed his first rule, "Use Pictures to Persuade," I have routinely broken his fifth rule of "Bullet Points Don't Wrap." Craig is adamant about this, "when I must use a bulleted list, I follow the ironclad rule that bullet points don't wrap. No 'buts.' No 'what ifs?' Never!" Depositions: Zoom, masks and severe frustration
"for allegedly coaching his client 'over 50 times' during a deposition in an employment dispute,"
Judge Leo T. Sorokin referred O'Hagan Meyer Managing Partner Jeffrey Rosin to a "Massachusetts lawyers assistance non-profit, Lawyers for Concerned Lawyers, for him to learn how to better manage his emotions and judgement in adversarial situations."
