Ridin' the RAILS
We have Doug Austin's co-presenter to thank for making us aware of RAILS - Responsible AI in Legal Services, created by the Duke Center on Law & Tech. I've bookmarked and browsed it briefly and I'm sure I'll be back to check on it again. The analysis Doug references, as of March 14th, contains 9 Court-Level Orders/Rules, 19 Judge-Level Orders/Rules, 7 Case-Level Orders and 2 guidelines/policy identified in the US Federal and State Courts. It's nice to have all this in one convenient spot! Mountains or molehills?
I am sure the US Judicial Conference has committees out the wazoo, but this post concerns the Advisory Committee on Evidence Rules and their responsibility for "drafting evidence-related amendments to the Federal Rules of Evidence." Friday they got together with computer scientists and academics "about the potential risks of AI being used to manipulate images and videos or create deepfakes that could disrupt a trial." Given the state of AI and its ability to deepfake nearly anything (text, audio, images, and videos), it certainly makes sense. "US Circuit Judge Richard Sullivan and US District Judge Valerie Caproni, reportedly expressed skepticism about the urgency of the issue, noting that there have been few instances so far of judges being asked to exclude AI-generated evidence." AI Security Stats
Sinisa Markovic's post helps remind us that while we are all fascinated by AI, we cannot forget the security side. If I go through and cherry pick some of the more interesting stats, I'd add: "Today, enterprises block 18.5% of all AI transactions, a 577% increase from April to January, for a total of more than 2.6 billion blocked transactions"; "Of the people who clicked on fraudulent links from supposed tax services, 68% lost money. Among those, 29% lost more than $2,500, and 17% lost more than $10,000"; and "98% of companies surveyed view some of their AI models as vital for business success, and 77% have experienced breaches in their AI systems over the past year."
