Night and Day

There is a huge difference between setting a corporate retention and destruction policy and then what you can do once you're under a litigation hold. Joe Patrice has an interesting post where it would seem that former Jones Day lawyer, Joe Sims, lost track of that in his tweets. Joe Patrice writes, "Staying atop the exact moment when the document retention policy - more accurately the 'document deletion policy' - has to be turned off is a big part of not having the court put the client put on blast for spoliation. And it's not as easy as it used to be. Lawyers aren't just locking away Bankers Boxes or grabbing .psts anymore. There are smartphones and tablets and Teams convos and Zoom logs and, as relevant to this case, employee chats." This is a learning article. What do your hold policies cover and what tech do you have that enforces it? Read more at ABOVE THE LAW: Maybe Don't Tweet That Destroying Evidence Subject To Lit Hold Is A Good Idea?

I am convinced that if people looked objectively at the meeting and asked themselves question #1, half of all meetings would never happen. They'd become a phone call or an email. The chart on decision, discussion and information-sharing meetings types is a great visual for question #2. And for #3, knowing what roles you play in the meeting (decision maker(s), advisors, recommenders or execution partners helps things move along. Be sure to leave Stephen Abram

Stone throwing

I was not aware but it seems that sometime before Delta blamed CrowdStrike and Microsoft and calculated their losses at over $500 million, they moved into a glass headquarters. Delta refused free help from both Microsoft and CrowdStrike. Apparently Delta didn't want them to see how ancient their systems were. Do you think there is any truth to the rumor that the only systems unaffected at Delta were running MS-DOS and Windows ME?
