Things that make me go hmmmm
This post by William Josten has me scratching my head. Either we don't play in the same legal vertical or I'm having a serious senior moment processing his comments. His post basically tries to address two AI-related questions that are getting asked. The first is "What impact is generative AI (GenAI) having on law firm billing?" And while he goes into greater detail, his answer is "The truthful answer is not much... yet." That I can process just fine. I agree. Those firms who have figured out some aspects of AI haven't really figured out how it impacts pricing yet. My brain seems to stop working with response to the second question, "How are law firms planning to recover the costs for their new AI technologies?" It's a good question but William disagrees with the framing of the question. He zeros in on cost recovery and claims it's a 30 year old mindset related to "online legal research services to photocopies to long distance phone calls." Here my brain starts misfiring. AI not as cut and dried as research, photocopies (and scans) and phone calls. There are still firms that charge for photocopies and scans to recover those costs. Some firms have added a percentage of the bill for these and other administrative overhead costs. Years ago most clients refused to pay research costs outright and firms started to either absorb those costs or attempted to recover them with higher attorney rates and establishing billing rates for library professionals. With the advent of cell phone and voice over IP technologies, long distance charges pretty much evaporated. We haven't touched all the billings and cost recovery being used in eDiscovery or in charging for things like DocuSign envelopes. William writes, "The costs of advanced AI technology should not be lumped into this category." He seems to imply that advanced tech should not be subject to any sort of return on investment examination or scrutiny on its impact on workflows or any ability to directly recover the costs. Indeed there are aspect of technology that have always been an overhead. But I cannot think of any technology project I have considered in the last 30 years where I didn't examine it for cost recoveries, either directly, or indirectly through improved work, time savings or some other aspect. As I read the title I pondered if this was a real issue in 2024 where online repositories dominate the market. I mean it can't be that hard can it? Dr. Gavin Manes writes about changing hosting solution and changing the platform itself. I suppose if are using an on-prem product, you may need to swap the hosting out, although you could also purchase the software and set it up and then it would be as easy as copying files. If you're using a provider, they can all easily make the switch from your previous employer to the new and thus avoid a platform switch all together. And I suppose you might go to work for someone using a different eDiscovery platform, but then why would you want to switch from what you know? And what client is going to want to pay all those conversion fees? Maybe it is my second senior moment of the day, but I'm struggling to see the validity of all of this. I guess if you do make any of these odd sort of swaps, then he raises some valid points. Read more at

Sometimes you can't tell the players even with a scorecard! The 2024 developer conference Google I/O was full of names: Bard, now know as Gemini, unless your talking about the Gemini Pro or Gemini 1.5 Flash versions. Sora, now called Veo and its ability to generate 1080p videos from text, image or video prompts. And Google actually does some new hardware as well: a new sixth generation GPU called Trillium.
