Law Firm Marketing Brief

- Innovation in a Box. It's never easy to pioneer a new business model, particularly in the face of the sort of rapid change that we see in the legal market today. But hats off to the folks at Reynen Court who are doggedly pursuing their vision of building a technology platform that will help accelerate the pace of tech adoption in the market. Reynen Court started out in life as a consortium among BigLaw firms, who were financial backers of the effort, such as Clifford Chance and Latham & Watkins. With their latest product announcement, they seem to be pivoting, turning their attention to mid-sized firms and the corporate side of the market. Reynen Court's new offering, called Innovation in a Box, is designed to provide smaller firms and corporate law departments with an easy way to test and deploy cloud-based legal technology. If nothing else, it is certainly a good marketing move - the idea of making innovation seem easy and turnkey is quite compelling, even if it is somewhat misleading, since people, not technology, usually pose the primary obstacle to change.
- Deep Automation as a Competitive Advantage. Here's an interesting article by Elizabeth Basten, the CMO of Claralis, a legal drafting automation platform, about how deep automation, using AI & ML, is beginning to transform the M&A deal process. One of the takeaways from the article is how a few mid-sized law firms in the UK, which have been at the forefront of driving this trend, have achieved a significant advantage in a highly competitive market by using technology to accelerate the deal process.
- Dispersed Firms.
What exactly is a dispersed law firm? That's the term UK publisher Legal Futures is now using to describe Rimon - a dispersed firm on the verge of entering the UK market in a big way. In the era of WFH, it would seem like most firms are more or less dispersed already. But the dispersed firm model, as Legal Futures is using the term, goes beyond physical dispersion of the work force. The Rimon firm is organized along the lines of Fisher Broyles, in that its partners operate with considerable independence and are allowed to retain a majority of what they bill - in Rimon's case, that means 70%. So the firm is dispersed in the sense it is really a loose confederacy of partners, sharing a common infrastructure, but they are far less bound together financially than the traditional law firm partnership. It will be interesting to see if the dispersed law firm model is poised to become that much more attractive to lawyers now that they are primarily WFH anyway. It is certainly one answer to what Bruce MacEwen calls "the structural tension" at the heart of the BigLaw enterprise today.
- Move Over Willie Nelson. All of a sudden Austin is the rage as a destination for VCs, tech start-ups and deal-makers. This week two law firms announced their moves into what used to be derided as Bat City -- Kirkland & Ellis and Gunderson Dettmer -- signaling Austin's growing importance as the start-up hub alternative to Silicon Valley. Dispersed or not, the deal-makers are heading for Austin.
- Litigation Ain't What it Used to Be. It may be a bit premature to predict the demise of the litigation business but there are a number of efforts underway to reinvent dispute resolution as a more streamlined and client-centric process. FairClaims became the second company in as many weeks to launch a new fast track online arbitration system, designed to handle disputes for small and mid-sized businesses. While FairClaims targets lawyers at smaller firms, as an alternative to the higher cost-structure of ADR services offered by JAMs and AAA, it's easy to see how this would have much broader appeal, if it proves successful. And as Mark Cohen notes in his most recent blogpost, there are a number of other initiatives underway across the legal market to use advanced technology in order to prevent or provide early warning detection of litigation risk, aiming to strike at the root cause of litigation. Personally, I'm far less sanguine than Cohen about the prospect of technology itself leading to a significant reduction in business disputes. Technology seems just as likely to give rise to disputes as it is to quell them and for that reason I think it's reasonable to assume litigation -- streamlined or not -- will be with us far into the future.
- Mergerless Growth. This story profiles how the Benesch law firm has used lateral hiring, instead of pursuing mergers, as a primary strategy to support its growth. Of course, lateral hiring is not without risk itself, given the ease and rapidity with which lawyers hop from firm to firm, but the article suggests Benesch has devoted considerable effort to creating a support system for laterals, which has boosted their retention rate and helped keep the firm's growth plans on track.
